Prior art does not come into the picture until the patent is contested. The patent office cannot, and does not, check for those aspects. They expect the courts to take care of that. Yes, in an ideal world, they would be experts and look through the literature (perhaps even spend 10 minutes with Google) and look for prior art. But then, in a perfect world, perhaps we wouldn't have software patents.
I was against Johnson's Great Society because it turned into a "grate society". It lowered literacy rates and increased the number of folks on welfare, besides destroying the family structure of Black families. And, it spent over $7 Trillion to achieve those miserable results. I think conservatives do a better job of running social programs than liberals, because making people dependent on Government is not a solution that works. Except for professional welfare recipients most people want a hand up, not a hand out.
