"rm -rf ~/.local/share/Trash/*" will empty it, and hopefully remove anything that could be interfering with the trash's normal operation (e.g. weird filenames).
After you do that, see if the trash operates normally.

That happened to me on feisty. I rebooted into recoverymode and opened kde with startx at the promt. Now see if you can empty your trash on root and /home/yourusername/.local/share/Trash?

Just a wild guess, but are you right-clicking on the Trash icon instead of left-clicking?

I have no idea if this is the right way, but I had this problem regularly on Feisty. I opened the trashcan, selected everything in it and pressed Shift + delete. Everything was gone and after that the trashcan worked again, till after a few days same thing happened.
But take care: I'm not an experienced linux user.

Until you get a solution that fixes the problem 'permanently' you can try this:
Open Konqueror and type in the URL:
Code:
trash:/
This opens the Trash folder and you can delete contents from there. This works in Feisty, so I'd assume it would work in Gutsy as well.
