    I need to reboot but all looks good. No packages actually needed installation it seems, just the grub update and some reconfiguration. So I gues the answer to my original question is "almost OK"

    Im guessing the culprit was boost that asked me to mark additional packages on reboot for installation and probably where the upgrade failed, although its not clear to me why. I am glad to know everything is properly set up and config'd thanks for the help, it took a bit of grief from my evening,

        hmmmm so it looks like I MIGHT haave spoke to soon... I did not have a chance to start up again untill after work tonight, there seems to be a couple problems. Grub isnt properly updating when running update-grub I can see it find several kernals including above 3,0 discovered, but do not appear in the menu on reboot, the most recent being 11.10 and older kernal 3.0. Although the desktop is themed and has the backround for LTS the animated spalsh screen is still from 11.10.

        Is there a way anyone knows around this without manually creating the entry in grub? Any ideas on the mixed theme?

          I know its a tad unnecessary but sometimes I like to use chroot to fix upgrade issues.
